Part 1 – General Principles (Intent)

The Hunter Medical Research Institute (HMRI) aims to advance the impact of health research, to facilitate changing knowledge, health policy, health systems and clinical practice, with the aim of improving the health and wellbeing of society and the economy.

The Framework to Assess the Impact from Translational health research (FAIT) is a novel framework specifically developed by HMRI to encourage research translation and measure and report on research impact in a multi-dimensional way.

FAIT seeks to encourage and assist in the translation of research into policy and practice by making the pathways to impact more transparent and encouraging researchers to think and plan for translation and impact upfront.

The application of FAIT requires some guidance, at least initially. The team at HMRI have developed resources (a series of modules) to support the application of FAIT. These modules are currently customised for cardiovascular research but are able to be utilised by all researchers.

The modules are loaded onto the Thinkific software platform. Following a registration process, these online modules are available for use in connection with research, study or personal purposes, free of charge, subject to these Conditions of Use.


Part 2 – Ownership of Intellectual Property

HMRI owns all intellectual property in the FAIT modules and content prepared by HMRI with the exception of:

    1. Intellectual property of the Thinkific platform;
    2. Scholarly Works included as references in the FAIT modules or 
    3. Copyright content which the User creates using FAIT resources and methodology (for which the copyright is owned by the author of that content).

HMRI grants the User a nonexclusive, nontransferable perpetual license to use the intellectual property in the FAIT modules in accordance with these Conditions of Use.

The User warrants that any content, data, information or material that it creates using FAIT resources or methods will not infringe any intellectual property right of a third party.  The User agrees to indemnify HMRI against any claim, cost, loss or damage in connection with any infringement or alleged infringement by the User of any third party intellectual property right in connection with its use of FAIT. 


Part 3 – Users of the FAIT Modules

1. Application

These Conditions of use apply to all users of the FAIT modules.  

2. Access

The FAIT modules were developed and will be updated and maintained to support the achievement of HMRI’s objectives in conjunction with the Intent outlined above.  Access to and use of the FAIT online modules is not provided to users unconditionally and is subject to these Conditions of Use and HMRI policies and procedures.  

3. No Liability

HMRI gives no warranties regarding the reliability or performance of FAIT and accepts no responsibility nor liability for any loss or damage (including consequential or direct or indirect losses), arising in connection with the use of the FAIT modules

4. Failure to comply

A failure to comply with these Conditions of use may result in (without limitation):

    1. For employees, referral to the relevant employer for disciplinary action;
    2. For students, referral of the matter to the University for disciplinary action;
    3. For all users (including employees and students), 
        1. restriction or cancellation of access to FAIT online modules and other HMRI resources;
        2. in appropriate circumstances, referral to a relevant, external regulatory authority.


Part 4 – Conditions of use

1. Permissible uses

Users may access the FAIT online modules for legitimate research and study purposes and in the course of their employment.

Users are permitted to print, save, copy or modify FAIT documents and material for personal use relating to research, study or in carrying out the User’s employment duties.    

2. Requirements

Users must not share with any other person and must keep secure the login details for the FAIT modules on the Thinkific platform.

Users must, when using the FAIT modules, do so in a responsible, ethical and equitable manner and in accordance with all applicable laws.

Users must promptly report any breach of these Conditions of use or any suspected breach or compromise to the security of HMRI’s information technology system to [email protected]

3. Restrictions on use

Users must not:

    1. download, share, transmit or store any material or content sourced from the FAIT modules except for purposes of research carried out by the User and/or education of the User;
    2. use the FAIT modules in a manner that constitutes an infringement of copyright or infringes a third party’s moral rights (as defined under the Copyright Act 1968 (Cth); or to collect, use or disclose personal information in a manner that contravenes the Privacy Act 1988 (or other relevant legislation or regulations); 
    3. use, download, share, transmit or store material or content sourced from the FAIT modules for:
        1. the education of others;
        2. marketing or advertising; or 
        3. any profit making or commercial activities or purposes, without express written authority from HMRI


Part 5 – Monitoring and Confidentiality

HMRI reserves the right to view, monitor, audit, copy, move, delete or otherwise handle (at its discretion) any data, information or content stored on or accessed through the FAIT Thinkific platform.

HMRI reserves the right to remove or restrict access to any User of the FAIT Thinkific platform at any time without prior notice.

Whilst HMRI’s systems are electronically safeguarded and maintained, HMRI provides no warranties, assurances or guarantees regarding the confidentiality, integrity and/or availability of any material stored on the FAIT Thinkific Platform.


Part 6 – Definitions

Commercialise means to make, sell, copy, adapt, apply, publish, develop, use, assign, license or otherwise utilise the material (or IP) for the purpose of generating financial or other commercial gains.

FAIT online modules means the electronic operating platform including software, webpages and websites.

FAIT modules (or modules) means the content accessible or available using the FAIT online modules.

Scholarly Works (copyright work which is the output of academics including academic publications, journal articles, papers, presentations and other creative works).
